Terms of Service
These terms are an agreement between you and Eat.Read.Love. Inc., doing business as Evergreen Viral Media (2029 Verdugo Blvd, Montrose, CA 91020) ("we", "us") for using Evergreen Viral Media (the website, the app and the results it makes, together "the service"). By signing in you accept them. Our Privacy Policy explains how we handle your information.
1. The service and its limits
You can create an account yourself from the website. When we are at capacity, new accounts wait on a waitlist until a spot opens. Features change, and limits apply: for example the number of videos a plan includes each month, file size, how many videos you can have waiting at once, and how long files are kept. All creators' videos wait in one line and are made in turn, so the time a video takes depends on how many are ahead of it; the app shows an estimate. The service may be unavailable at times. One account is for one person; accounts made to get extra free trials may be closed.
2. Who can use it
You must be at least 18 and able to enter into this agreement. If you use the service for a business, you accept these terms for that business.
3. Your content
- You keep ownership of the videos you bring and of what the service makes from them.
- You must have the rights. You only upload or import videos you own or have permission to use, including the right to edit them and to post the results. You promise this each time, and when you import from a link you confirm it in the app. You are responsible for the content you bring and post.
- Permission you give us: you let us store, process and edit your content only to run the service for you: to make, show, deliver and (when you approve) post your results. This permission ends when your content is deleted.
- We don't sell your content, use it for advertising, or use it to train AI models.
4. What you may not do
- Bring content you don't have the rights to, or content that is unlawful, harmful, harassing, sexual content involving minors, or that infringes others' rights.
- Try to get into other people's accounts or projects, overload the service, or reverse-engineer it.
- Share your sign-in link or account with others.
We may remove content or suspend access that breaks these rules.
5. Posting to other platforms
When you connect an account on another platform (YouTube, TikTok or Instagram), you also agree to that platform's terms. For YouTube, by using the YouTube features of the service you agree to be bound by the YouTube Terms of Service. We post only what you approve. Each platform decides what it allows, and may limit or remove posts.
6. Results made by AI
Cuts, Shorts, captions, titles and chapters are made automatically and can contain mistakes. Check your results before you publish them; you decide what goes out under your name.
7. Fees
Paid plans are monthly subscriptions with a set number of videos per month; extra videos can be bought as one-time top-ups. Prices are shown before you buy. Payments are taken by our online store, which runs on Shopify; we never see your full card details.
- Free trial: a new subscription starts with a [TO CONFIRM: 3]-day free trial that includes [TO CONFIRM: 3] videos. Your card is saved at checkout and the first monthly payment is charged automatically when the trial ends, unless you cancel before then. One free trial per person.
- Renewal: your plan renews automatically every month on the same date and is charged to your saved card until you cancel. Unused videos in a month do not carry over; top-up videos stay until used.
- Cancelling: cancel any time from your account on our store. You keep your plan until the end of the period you paid for; no further payments are taken.
- Failed payment: if a renewal can't be charged, new videos pause; your finished projects stay available until they are removed as usual.
- Refunds: [TO CONFIRM: refund policy, e.g. no refunds for a month already started, except where the law requires].
- Price changes: we tell you at least [TO CONFIRM: 30] days before a new price applies to your plan, and you can cancel before it does.
8. No warranty
The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. Keep your own copies of your original videos; files on the service are removed after 14 days.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits, data or audience, and our total liability for any claim is limited to US $100.
10. Ending
You can stop using the service at any time. You can download your data or delete your account yourself under Your account in the app; deleting it disconnects your linked platforms at once and removes your videos and records within 30 days. Deleting your account does not cancel a subscription on our store: cancel that there too. We may suspend or end your access if you break these terms. Sections 3 (your ownership), 8 and 9 continue after it ends.
11. Changes
We may update these terms. We will change the date above and tell you in the app or by email when a change matters. Using the service after that means you accept the new terms.
12. Law
These terms are governed by the laws of the State of California, and disputes go to the courts of Los Angeles County, California.
